These Terms & Conditions apply to the use of the Banksia Portraits website and to photography services provided by Banksia Portraits. By accessing this website, making an enquiry, placing a booking or purchasing services or products from us, you agree to these Terms & Conditions.

2. Bookings
A booking is confirmed once Banksia Portraits accepts the booking request and any required booking fee, session fee or deposit has been paid.
Quoted prices, inclusions and delivery details will be set out in your quote, invoice, booking confirmation or other written communication. All bookings are subject to availability.
3. Pricing and payment
All prices are in Australian dollars unless otherwise stated.
Session fees, packages, artwork, prints, albums, digital files and any additional products or services must be paid in accordance with the payment terms set out in your quote, invoice or booking confirmation.
Banksia Portraits may require full payment, part payment or a deposit before a session date or before final delivery of images and products.
Late payments may result in delays to editing, gallery delivery, product ordering or final delivery.
4. Rescheduling and cancellations
If you need to reschedule a session, please contact us as soon as possible. We will make reasonable efforts to offer an alternative date, but rescheduling is subject to availability.
If Banksia Portraits needs to reschedule due to illness, emergency, unsafe conditions, severe weather, venue restrictions or circumstances beyond our reasonable control, we will make reasonable efforts to arrange a new date.
Booking fees or deposits may be non-refundable where clearly stated at the time of booking, except where required otherwise by law.
5. Late arrival and non-attendance
Please arrive on time for your session. Late arrival may reduce the available shooting time and may affect the number or variety of images captured.
If a client does not attend a confirmed booking without reasonable notice, Banksia Portraits may treat the booking as cancelled.
6. Session conditions
Clients are responsible for ensuring that all participants are ready for the session and that any required permissions for locations, venues or private property have been obtained unless otherwise agreed in writing.
For sessions involving children, a parent or legal guardian must remain responsible for the child or children at all times unless otherwise agreed.
Banksia Portraits reserves the right to stop or refuse a session where there is unsafe, abusive, inappropriate or unlawful behaviour.
7. Artistic approach and image delivery
By booking with Banksia Portraits, you acknowledge that you are engaging us for our creative style, judgement and editing approach.
The final gallery, image selection, editing style, cropping decisions and delivery format remain at the artistic discretion of Banksia Portraits, subject to any agreed package inclusions.
Raw or unedited files are not included unless expressly agreed in writing.
Estimated turnaround times are indicative only and may vary depending on workload, peak periods, product suppliers and the nature of the project.
8. Galleries, downloads and archival
Online galleries may be provided for proofing, selection, downloading or ordering where applicable. Gallery access periods may be limited and will be advised where relevant.
Clients are encouraged to download and store purchased digital files promptly and to keep their own backups. Banksia Portraits is not responsible for long-term digital storage once images have been delivered.
Unless otherwise agreed, Banksia Portraits is not obliged to archive images indefinitely.
9. Prints, albums and artwork
Prints, albums, frames and other products may vary slightly in colour, tone or appearance from how they appear on screen due to differences in screens, materials and production processes.
Production and delivery timeframes for physical products may vary depending on supplier and shipping conditions.
10. Client responsibilities
You agree that the information you provide to Banksia Portraits will be accurate and complete to the best of your knowledge.
You are responsible for communicating any important circumstances that may affect the session, including timing restrictions, access limitations, special needs, sensitivities or relevant concerns regarding children participating in the session.
11. Use of images and copyright
Unless otherwise agreed in writing, copyright in photographs and creative works produced by Banksia Portraits remains the property of Banksia Portraits.
Clients are granted a personal, non-exclusive, non-transferable licence to use purchased images for private and personal use. This includes sharing with family and friends and personal social media use, provided the images are not altered in a way that misrepresents the work.
Images must not be sold, licensed, submitted for commercial publication, used in paid advertising, used for business promotion or entered into commercial competitions without prior written permission from Banksia Portraits.
Where images are supplied for branding or commercial use, the permitted usage will be governed by the written licence terms agreed for that project.
12. Permission to feature images
Banksia Portraits will not use identifiable client images for website, portfolio, social media, studio samples or promotional purposes without permission where such permission is required by our agreement with you or by law.
Where you provide written consent for promotional use, that consent may be relied upon unless withdrawn in writing for future use.
13. Website use
You may browse this website for lawful purposes only. You must not misuse the website, attempt to gain unauthorised access, interfere with its operation, introduce malicious material or use website content in a way that infringes our rights or the rights of others.
